That’s one spicy lawsuit

If you can’t handle the heat, get out of the kitchen, and also the courtroom.

According to Gothamist, U.S. District Judge Dale Ho sided with a New York City restaurant after a German tourist sued them for distress he allegedly suffered after consuming their green salsa.

“I felt I was too hot. My mind, my head,” the tourist, Faycal Manz, tells Gothamist. “I contacted my wife — I said there’s a problem with the sauce.”

Manz alleged that the sauce caused his tongue and face to burn and his heart rate to jump, and he continued to suffer with days of stomach issues and mouth sores.

“I have this German mind: If something is too spicy, it should be warned — or at least labeled,” Manz says.

However, Ho ruled “there is no duty to warn a consumer of the spice-associated risks that come with consuming salsa.”

“In fact, when it comes to salsa, the spice is often the point,” the judge said.

Manz, by the way, filed two other, unrelated lawsuits stemming from his visit to NYC. 

“The main objective for me is to help,” Manz says. “To correct something I think is wrong.”
