ADDITITIONAL NOTICE OF SHOW-CAUSE HEARING

At the regular meeting on Wednesday, October 28, 2026

TO: Columbia Gorge Regional Airport; City of The Dalles; Klickitat County; their authorized governing representatives and counsel; and the agents identified in the respondent-specific hearing materials.

Time: Regular meeting begins at 2:30 p.m. Pacific time. The hearing will be called when the agenda item is reached, no earlier than 2:30 p.m.

Place: Dallesport Community Center, 136 6th Avenue, Dallesport, Washington 98617.

PLEASE TAKE NOTICE that the Dallesport Water District Board will hold a hearing on the matters below pursuant to the authorizing resolution passed at its special meeting on Tuesday, October 20, 2026, at 1:30 p.m., at the District’s main office, 302 6th Avenue, Dallesport, Washington.

1. Payment, equal application of requirements, and eleven connections.

The Airport and its owners are afforded an opportunity to show cause why they should not be required to pay and comply with the same lawful water-service, connection and enforcement requirements applied to other persons who fail or refuse to pay for water services. The Manager’s reports identify eleven illegal Airport water connections and unpaid associated charges. The hearing will address the Airport’s and each owner’s own conduct, and the conduct attributed to their agents, in procuring, directing, authorizing, installing, maintaining, aiding or abetting those connections.

Present the permits, District connection allocations, Department of Health approvals, installation and activation records, meter and payment records, contracts, testimony and other evidence supporting any contention that a connection was authorized, a charge paid, a duty performed, an attributed act did not occur, or an asserted liability or remedy does not apply. Identify the particular connection, respondent, period and record for each response.

2. Other violations, Plan departures, and alleged agent conduct.

The hearing includes other source-linked matters: well and water-right transfers; easements and source protection; source, treatment, pumping and fire-flow capacity; treatment-vessel funding and procurement; service and metering; cross-connection and backflow protection; Phase II and hangar-line design, construction, project approval and service authorization; payment, public-money and contractual-performance obligations; and the Manager-reported false statements, official reports or certificates, records conduct and other alleged crimes bearing on the water-law violations and repeated noncompliance.

A respondent may answer each allegation and offer testimony, records and legal argument concerning its own acts, authority, notice, knowledge and responsibility. The Board will receive that response before making the disputed individual determinations within its authority.

3. Appearance, evidence, record access and public comment.

The Airport, City and County may appear through counsel or authorized representatives, present witnesses and documents, dispute particular acts and amounts, identify payments and defenses, and address the proposed findings, remedies and calculations. Comments of counsel, however, are not considered testimony. Written submissions may be delivered before or at the hearing. Identify the respondent, relevant exhibit or item, and supporting document with each response. The Board will also receive public comment before final action and will make and record individual determinations on the evidence under the governing authority.
