A federal judge dismissed much of Alec Baldwin’s civil rights lawsuit against prosecutors in the Rust case Wednesday, ruling they are protected from liability by prosecutorial immunity.
Baldwin sued special prosecutor Kari Morrissey and other officials, alleging misconduct in the criminal case stemming from the 2021 shooting death of cinematographer Halyna Hutchins. Judge Kea Riggs said the allegations presented a “very disturbing picture” but ruled that prosecutors are generally immune from lawsuits over actions taken as part of their prosecutorial duties.
Some claims against Morrissey remain, including allegations involving statements to the media and her handling of ammunition evidence. Baldwin’s separate claims against Santa Fe County and sheriff’s investigators also remain pending.
Baldwin’s involuntary manslaughter trial was dismissed in July 2024 after the judge found prosecutors had withheld evidence from the defense. The charge was dismissed with prejudice, preventing it from being refiled. (Variety)
