Alan Swinney arrested, charged for recent criminal conduct in downtown Portland

PORTLAND, Ore. – Today, Multnomah County District Attorney Mike Schmidt announced that 50-year-old Alan Swinney is in custody and is being charged with multiple offenses for alleged crimes and assaults that involved weapons. The alleged crimes occurred in downtown during recent demonstrations.  

Swinney is charged with one count of assault in the fourth degree, one count of attempted assault in the fourth degree, two counts of unlawful use of mace in the second degree, one count of attempted assault in the second degree, three counts of unlawful use of a weapon, two counts of assault in the second degree, one count of menacing and one count of pointing a firearm at another person.

In summary, the indictment alleges that Swinney used a paintball gun on August 15, 2020 to cause physical injury to another person; that he unlawfully discharged mace or a similar substance at someone and that he attempted to assault others, including one instance using the paintball gun.

Further, the indictment alleges that Swinney used a paintball gun on August 22, 2020 to once again cause physical injury to another person; that he also carried and then pointed a revolver at someone which placed that person in fear of imminent serious physical injury and that he unlawfully discharged mace or a similar substance toward another person. 

The indictment in this matter was filed on September 11, 2020.

The court sealed both the indictment and the arrest warrant until Swinney was arrested.

When an indictment or warrant is not available for public inspection, the district attorney’s office is often limited, by law, from disclosing the existence of an indictment or arrest warrant.

On September 30, 2020, the Portland Police Bureau booked Swinney into the Multnomah County Detention Center.

Swinney’s arraignment is scheduled for October 1, 2020.

No additional information can be released by the Multnomah County District Attorney’s Office at this time.

A charging document is only an accusation of a crime. Swinney is innocent unless and until proven guilty.
